Blackboard essentially wants proprietary rights over features that existing patents can also claim (and have done). Oh, right: Alan Levine's Cogdogblog weighed in early on with info on the earlier patent. But as far as the latest, Feldstein's really the man for info on Desire2Learn's prior art evidence needs,. But as of this posting, the latest comes via the NOSE (AKA Tatler), who basically thinks all the litigation adds up to war; he sees the Blackboard patent dispute as part of a larger IP question. But now reading the Socrates patent I am scared. They seem to talk about learning in a dialogue and many other methods of learning that really make sense. I am out of business.
